General Terms and Conditions – Knust Porselen AS
1. GENERAL
1.1
These general terms and conditions ("General Terms") apply when you as a consumer ("You" or the "Customer") place an order via www.knustporselen.no and related pages (the "Website"). The agreement is entered into between you and Knust Porselen AS, organisation number 921 499 280 ("Knust Porselen/KP"). Detailed contact information and other information about Knust Porselen can be found on the Website. The General Terms apply only to Customers who are consumers.
1.2
You must be at least 18 years of age to place an order via the Website. In accordance with Norwegian legislation, Knust Porselen does not accept credit purchases by persons under 18 years of age. Knust Porselen reserves the right to reject or amend your orders (for example, if you have provided incorrect personal information and/or have a history of non-payment).
1.3
Knust Porselen shall have no liability if products are sold out, nor for image or typographical errors on the Website, such as errors in product descriptions or technical specifications, inaccurate prices and price adjustments (such as changes in supplier prices, currency fluctuations), or incorrect information regarding whether a product is in stock. Knust Porselen has the right to correct such errors and to change or update information at any time. If an incorrect price has been stated for a product you have ordered, Knust Porselen will of course inform you of this and await your approval of the amended price before continuing with the order process. All images on the Website shall be regarded as illustrations only. Such illustrations do not guarantee the quantity of products you will receive or the exact appearance, function, or origin of the product. Knust Porselen is not responsible for information provided to the Website by third parties.
1.4
The Website and all content thereon are owned by Knust Porselen or its licensors. The information is protected by intellectual property law and marketing legislation. This means that trademarks, company names, product names, images and graphics, design, layout, and information about products, services, and other content may not be copied or used without the prior written consent of Knust Porselen.
2. CONTRACTS AND ORDERS
2.1
To place an order through the Website, you must accept the General Terms. By accepting the General Terms, you undertake to comply with them in full and acknowledge that you have read the information on personal data and cookies and consent to their use in accordance with Knust Porselen's Privacy Policy.
2.2
A purchase agreement is concluded when Knust Porselen has confirmed your order and you have received an order confirmation from Knust Porselen by email. Knust Porselen encourages you to retain the order confirmation for any future contact with Knust Porselen's customer service regarding the order. You have the right to cancel your order until it has been confirmed by Knust Porselen. If the order is cancelled, Knust Porselen shall refund any payments made by you or your credit card company in respect of the order.
3. CUSTOMER INFORMATION ETC.
3.1
When you visit the Website and have completed a purchase, KP processes your personal data for purposes including providing you with the best possible website experience and fulfilling purchase agreements with you. You confirm that the information you provide is correct and complete and that you are responsible for any inaccurate information. Information about KP's processing of personal data can be found in KP's Privacy Policy.
3.2
You undertake to ensure that no one other than you uses your login credentials. You are not permitted to disclose your username or password to anyone and shall ensure that any documentation containing username and password information is stored so that unauthorised persons cannot access it. You shall notify Knust Porselen without delay if there is any suspicion that an unauthorised person has gained access to your password. You are responsible for all purchases made with your login credentials if you have not given such notice.
3.3
If Knust Porselen suspects that you are misusing your user account or login credentials or otherwise violating the General Terms, Knust Porselen has the right to block access to your user account. Knust Porselen further has the right to assign you new login credentials.
4. PRICES, FEES, AND PAYMENT
4.1
The prices stated on the Website apply to orders placed on the Website. All prices are stated in NOK and include VAT. Prices do not include payment and shipping fees, which are stated separately.
4.2
You may pay for the purchase in the manner indicated on the Website. Knust Porselen reserves the right at any time not to offer all payment methods, or to change the payment method if the payment method you have selected does not function for any reason at the time of order fulfilment. Please note that any restrictions on available payment methods are stated on the Website.
4.3
For debit or credit card payments, the purchase amount will be reserved on your card at the time of order. Your card will be charged when the goods are dispatched from our warehouse. For invoice purchases, the invoice will be issued upon dispatch of the goods.
5. SPECIAL OFFERS
Knust Porselen may from time to time make special offers on the Website that are more favourable than those set out in these General Terms, for example regarding payment or extended right of withdrawal. Such terms shall apply for the duration of the special offer and for the specific products designated by Knust Porselen in connection therewith. Knust Porselen reserves the right to withdraw such special offers at any time. Upon expiry or withdrawal of a special offer, these General Terms shall apply without modification. Offers on specific products on the Website apply only for the limited period and until the products are sold out.
6. DELIVERY AND SHIPPING
6.1
Products in stock are normally delivered within 2–3 business days. Unless otherwise agreed (for example, in connection with the reservation of products not in stock), delivery shall take place no later than 30 business days after Knust Porselen has confirmed the order in writing in the order confirmation. 6.2
The expected delivery time is stated in the order confirmation, at checkout, and/or on the relevant product page on the Website. If there is a delivery delay, Knust Porselen will inform you and will continue to monitor the order. Unless otherwise expressly agreed, and if delivery is delayed by more than 30 business days for reasons not attributable to you as the Customer, you have the right to cancel the purchase.
6.3
If a parcel is to be collected at a specific delivery point, you must do so within the time frame stated in the notification. Parcels must normally be collected in person with valid identification and the order number. You will receive a delivery notification indicating when and where the parcel must be collected or received. The notification may be given by email, ordinary post, and, if you have provided a mobile number, also by telephone or SMS. Knust Porselen has the right to charge you a fee of NOK 149 if the parcel is not collected.
7. RIGHT OF WITHDRAWAL
7.1
Right of withdrawal.
7.2
When products are purchased on the Website, you have a 14-day right of withdrawal in accordance with applicable consumer protection legislation. This means that you have the right to cancel any purchase by notifying Knust Porselen within 14 days from the date on which you or your representative received the ordered product.
The right of withdrawal does not apply to the following product types:
a) products made to your specifications, or which otherwise have a clearly personalised character; b) products with broken seals that are returned for health-related or hygienic reasons (for example, underwear, cosmetics, swimwear, hair dryers and similar products, shaving products, electric toothbrushes, scales, electric pillows, and foot baths); c) products that are likely to deteriorate or expire rapidly; d) audio or video recordings (for example, CDs) or computer software where the seal was broken after delivery; or e) digital content that has been delivered other than on a physical medium (for example, computer programs, applications, games, music, videos, or texts accessed by download or streaming).
7.3
By accepting the General Terms, you acknowledge and agree that the right of withdrawal does not apply to digital content delivered other than on a physical medium.
7.4
When ordering a product to which the right of withdrawal does not apply, you will be clearly informed.
7.5
If you wish to exercise your right of withdrawal, you must, before the expiry of the withdrawal period, send a clear notification to Knust Porselen in the manner specified here. In the notification, you must state your name, address, and other relevant information, such as the order reference, invoice number, and the name of the product. Alternatively, you may use the standard withdrawal form issued by the Norwegian Ministry of Children, Equality, and Social Inclusion, available here.
7.6
If you exercise your right of withdrawal, you are responsible for the condition of the product after you have received it and during the return shipment. The product must be returned within 14 days from the date on which Knust Porselen was notified of your withdrawal. The product must be well packaged, in good condition, and in packaging suitable for postal transit.

7.7
If you exercise your right of withdrawal, Knust Porselen shall refund the amount you have paid for the product, including shipping costs. Any additional shipping costs resulting from your choice of a delivery method other than the standard delivery offered by Knust Porselen are excluded from the refund. If only part of an order is returned, shipping costs will not be refunded. Knust Porselen has the right to deduct an amount from the refund corresponding to the reduction in value of the product compared to its original value, if and to the extent that such reduction in value is attributable to your handling of the product beyond what is necessary to establish its nature, characteristics, or function.
7.8
Knust Porselen shall refund the amount without undue delay, but no later than within 14 days from the date on which Knust Porselen received your withdrawal notification. However, Knust Porselen may withhold the refund until it has received the product, or you have provided proof that the product has been returned, for example by way of a delivery confirmation. The refund shall be made to you using the same payment method that you selected, unless otherwise agreed or if there is any objection to such refund.
8. SPECIAL CONDITIONS
As a member of knustporselen.no, you may only hold one account. Knust Porselen reserves the right to terminate your membership if you act in breach of these terms.
9. COMPLAINTS AND WARRANTY
9.1
You have the right to make a complaint regarding products purchased on the Website if the product is defective. The complaint period is 2 (two) years after you received the product. For products intended to last significantly longer than two years under normal use, the complaint period is 5 (five) years. A complaint must be made within a reasonable time after you discovered or should have discovered the defect. A complaint made within two months of discovering the defect shall always be deemed to have been made in time.
9.2
Some of Knust Porselen's products may be subject to warranties. Information regarding any warranty period and specific warranty provisions for each product is set out on the Website or in these General Terms. Warranties for products shall cover only original manufacturing defects and shall consequently not cover any faults arising from or after any individual modifications to the product's function or appearance, such as alterations, upgrades, or other configurations. The Customer's order confirmation constitutes the warranty certificate.
9.3
A Customer wishing to exercise their right to make a complaint regarding an ordered product shall contact Knust Porselen as soon as possible after the defect was discovered, using the contact information available on the Website.
9.4
Knust Porselen shall bear the costs of return shipping for any approved complaints.
9.5
Once a product that has been the subject of a complaint has been returned and the complaint is accepted, Knust Porselen shall refund you in accordance with applicable consumer protection legislation. Knust Porselen endeavours to do so within 30 days of receiving the complaint, but this may be delayed depending on the product type. Knust Porselen reserves the right to reject any complaint if the product, in accordance with applicable consumer protection legislation, is found not to be defective. In connection with complaints, Knust Porselen complies with the guidelines issued by the Consumer Disputes Commission.
10. LINKS
Knust Porselen may provide links to other websites outside of Knust Porselen's control, and websites outside of Knust Porselen's control may provide links to the Website. Although Knust Porselen endeavours to ensure that it only provides links to websites that use similar personal data and security provisions as Knust Porselen's Privacy Policy, Knust Porselen is not responsible for any protection or confidentiality regarding information or personal data that you provide on other websites. You should exercise caution and read the privacy terms applicable to the website in question.
11. FORCE MAJEURE
Knust Porselen is not liable for any delays caused by circumstances beyond Knust Porselen's control, such as general labour disputes, acts of war, fire, lightning, terrorist attacks, changes in government regulations, technical problems, defects in power/telecommunications/computer communications or other communications, and defects or delays in services from subcontractors attributable to the aforementioned circumstances. Such circumstances shall constitute grounds for exemption from compensation and other remedies. If such a situation arises, Knust Porselen shall inform you accordingly both at the beginning and at the end of the period of the relevant situation. If the situation has persisted for more than two months, both you and Knust Porselen have the right to terminate the purchase with immediate effect.
12. AMENDMENTS TO THE GENERAL TERMS
Knust Porselen reserves the right to amend these General Terms at any time. Any amendments to these General Terms shall be published on the Website. Amendments shall take effect as soon as you have accepted the General Terms (in connection with a new purchase or while browsing the Website), or alternatively 30 days after Knust Porselen has notified you of the amendments. However, Knust Porselen recommends that you regularly keep yourself updated on the Website to be aware of any changes to the General Terms.
13. SEVERABILITY
If a competent court, authority, or arbitral tribunal considers any provision of this Agreement to be invalid or unenforceable, the remainder of that provision and all other provisions shall continue to be valid and enforceable to the fullest extent permitted by applicable law. Any provisions found to be invalid or unenforceable shall be replaced with relevant legal guidance and advice.
14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1
Any dispute that may arise shall first be sought resolved amicably through discussions with Knust Porselen's customer service. If an amicable resolution cannot be reached, Knust Porselen shall comply with the decisions of the Consumer Disputes Commission or the corresponding authority in other European countries.
14.2
Any dispute regarding the interpretation or application of these General Terms shall be governed by and construed in accordance with Norwegian law and shall be exclusively determined by the courts of Norway.
